I have been injured in an accident. What am I entitled
to payment for?
There are many types of losses that you can be compensated
for, including:
- pain and suffering;
- loss of income, loss of ability to earn any
income or loss of the ability to earn as much income
as you might otherwise have earned;
- cost of having people
care for you and assist you in daily living;
- rehabilitation
and occupational therapy costs;
- present and future
costs of medical equipment, supplies and aids;
- aids
for daily living at home or in the workplace
- retraining
for a different occupation;
- renovations to your home
to accommodate your injuries;
- compensation for family
members.
Can
I sue the person who caused my injuries?
In most cases you can sue the person who caused your injuries
and often you can sue individuals who could have prevented
your injuries.
How
long do I have to sue the person who caused my
injuries?
There are numerous limitation periods which dictate how long you have
to sue. There are also laws that require you to give
notice the person who is responsible for your injuries.
In some cases you may only have a
few days to give notice and if you don't give notice
you can't sue. In all cases you must consult a lawyer
immediately in order to determine what
is the limitation period and what is the deadline for
giving notice. My
insurance company has offered me a payment right
away as long as I sign a document. Should I take it?
NEVER sign any document presented to you in relation to your
injuries or losses without consulting a lawyer. You may be giving
up significant rights to compensation if you sign. The
insurance company will often try
to get you to give up your rights to a larger payment
so that you can get paid faster. I
can't work and I can't pay my bills or my medical
costs. What can I do?
If you are in a motor vehicle accident you are entitled to
immediate payments to replace the income that you have lost as
a result of the accident. You are also entitled to payments
to cover the cost of treatment, medication,
rehabilitation and other expenses. How
much will it cost me to sue for compensation?
In most cases you do not have to pay anything until we settle
your case. Our fees will be paid out of the settlement and
will be based on the amount you receive. Therefore we
will do everything possible to ensure
that your settlement is the maximum that you are entitled
to. I was charged as a result of a car accident in which
I was injured. Since it's only a small fine should
I just pay it instead of hiring
a lawyer to defend it?
Always obtain legal advice regarding criminal or driving
charges relating to an accident. Charges arising out of an accident can
seriously affect the outcome of claims for compensation
related to the same accident. As
well, even a minor conviction can result in a large increase
in your insurance rates. Often a lawyer can have charges
withdrawn or changed so as not to
affect your claim for compensation or your insurance. I
don't think that the insurance company is paying
me as much as they should to replace the income
that I have lost as a result of my accident.
What can I do?
If the insurance company is not paying you what they should
be paying, you can force them to pay what you are entitled to.
